Welcome to K.O. Photography. These Terms and Conditions (“Terms”) govern your access to and use of our website, photography sessions, and related services. By booking a session, purchasing a product, or using our website, you agree to comply with and be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our services.

1. General Information

K.O. Photography (“we,” “us,” “our”) provides professional photography services in Clarksville, Tennessee, and surrounding areas.
Our services include but are not limited to portrait sessions, family photos, events, weddings, and branding photography.
Our website is operated at www.kophotography.org.

2. Booking and Payments

• A non-refundable deposit of [insert percentage or amount, e.g., "$50 -25%" of the total session cost] is required to secure your booking date.

• The remaining balance must be paid no later than the day of the session unless otherwise stated in your contract.

• Bookings are not confirmed until the deposit has been received.

• Accepted payment methods include [insert methods – e.g., cash, check, Apple Pay, CashApp, Klarna, or credit/debit card].

Failure to pay in full by the due date may result in late fees or cancellation of your session.

3. Cancellations and Rescheduling

• If you need to reschedule, please provide at least 48 hours’ notice.

• One reschedule is permitted per booking, subject to availability.

• If you cancel your session less than 48 hours before your appointment, your deposit will be forfeited.

• There will be no cancellations after the session is completed. The client will be liable for the full amount of the project.

• K.O. Photography reserves the right to reschedule due to illness, emergencies, or inclement weather. In such cases, clients may reschedule or request a full refund of any payments made (excluding Deposit or completed services).

4. Image Rights and Usage

• Copyright Notice: All images remain the copyrighted property of K.O. Photography.

• Clients are granted personal usage rights only, meaning images may be printed, shared online, or displayed for personal use.

• Images may not be sold, edited, altered with filters, or used for commercial purposes without written permission.

• K.O. Photography reserves the right to use selected images for portfolio, marketing, social media, website, or promotional materials unless the client provides a written request for privacy at the time of booking.

5. Image Delivery

• Final, edited digital images will be delivered within approximately 2–4 weeks after your session via [online gallery or download link].

• RAW, unedited images will not be released under any circumstances.

• K.O. Photography is not responsible for the loss or damage of digital files after they have been delivered and downloaded by the client.

6. Client Responsibilities

• Clients are responsible for arriving on time and being prepared for their scheduled session.

• Late arrivals may result in reduced session time without a reduction in fees.

• Clients are responsible for obtaining any necessary permissions or permits for photography at chosen locations.

7. Liability

• K.O. Photography takes every reasonable precaution to ensure client safety and the protection of images.

• In the unlikely event that photographs are lost, stolen, or destroyed due to equipment malfunction or circumstances beyond our control, our liability is limited to a refund of all payments received for that session.

• K.O. Photography is not liable for injury, property damage, or loss incurred during a session.

8. Privacy Policy

We value your privacy. Any personal information collected (such as your name, contact information, and photographs) is used solely for communication, scheduling, and delivering services.
Your personal information will never be shared, sold, or distributed to third parties without your consent, except where required by law.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Tennessee.
Any disputes or claims shall be handled exclusively in the courts of Montgomery County, Tennessee.
